Legal Consent

Your legal consent is required for us to use and
​share your dogs' information with researchers. 

    Sharing Agreement
    Agreement and Consent to Unrestricted Sharing of Your Dogs' Records.

    When you choose "YES -- I consent" in the "Do you consent to this Sharing Agreement, without restriction?" box below, you agree to the Sharing Agreement below. Carefully read this Agreement before you consent to such sharing. 

    If you are not the sole legal owner of this dog, all other owners/co-owners of this dog MUST also complete this Agreement before we can process any order.

    DO NOT CONSENT TO THIS SHARING AGREEMENT UNLESS YOU UNDERSTAND THAT THE DDP MAY SHARE YOUR DOGS' DATA WITH OTHER RESEARCHERS AND THAT ONCE SHARED, IT IS NOT POSSIBLE TO STOP CONTINUED SHARING THAT MAY OCCUR WITHOUT YOUR FURTHER CONSENT AND/OR AGREEMENT. CONSENT TO SHARE ONLY IF YOU ARE COMFORTABLE WITH, AND AGREE TO, THE UNRESTRICTED SHARING OF YOUR DOGS' DATA. 

    ​You can always ask for your dogs' Data to be purged from the DDP's records. You may instruct the DDP to delete/destroy all Data pertaining to your dogs. Note well, however, that if the DDP has already shared your dogs' Data with another organization, your instruction to the DDP to destroy your dogs' Data will ONLY impact the data then held/controlled by the DDP. You agree that the DDP is not responsible for contacting any organization that has received your dogs' Data as a result of the DDP's sharing, with respect to Data destruction/handling/sharing, and agree that such contact is your sole responsibility. You further agree to hold the DDP harmless for any Data sharing/use/distribution, by any such receiving organization. If, at any time, you want your dogs' Data deleted from the DDP's records, email Robin.Loreth@DobermanDiversityProject.org and the requested purge will be completed within ninety (90) days. See Paragraph 11 (below) for details on obtaining a list of organizations who have received your dogs' Data.

    Your consent to this sharing is required for discounted testing through the DDP. If you wish to DNA test your dog without consenting to this Agreement, buy your DNA test kit directly from Embark Veterinary, Inc. 


    1. Data Sharing. To advance the understanding of how Doberman genomics and environment relate to health and longevity, the Doberman Diversity Project, Inc. (“DDP”) collects and shares data, records and information (hereinafter "Data"; see #3 below) with research teams across the world. By signing this Agreement (“Agreement”), you agree to and expressly permit the DDP to share your dogs’ Data with other researchers, research teams, universities, laboratories, and scientists, without restriction, for the purpose of advancing the understanding of Doberman health, longevity, genetics, diversity, and breed sustainability. This Agreement grants to the DDP unrestricted consent to use and share your dogs’ Data for the purpose of advancing the understanding of Doberman health, longevity, genetics, diversity, and breed sustainability. By signing this Agreement, you also expressly and without restriction, grant to Embark Veterinary, Inc. (“Embark”) permission to directly transfer your dogs' Data from Embark TO the DDP on an ongoing basis.
    2. Period of Agreement. This Agreement becomes effective on the date you sign this Agreement and continues to remain in effect until you revoke this Agreement by contacting the DDP as specified in Paragraph 10 of this Agreement. 
    3. Description of "Data". For the purposes of this Agreement, “Data” includes records of all types, including, but not limited to, DNA, genomic, health, test results, cardiac records, demographic and descriptive data, raw and processed data, clinical data, Holter data, and other information collected by the DDP, whether in digital or paper/physical form. 
    4. Dogs Included in Agreement. This Agreement includes all of Your Dogs that have been DNA tested by Embark Veterinary and/or enrolled with the DDP. “Your Dogs” includes Embark-tested dogs you own, co-own, have leased, or otherwise have the legal right to test and consent to this Agreement.  
    5. Certification of Ownership and Legal Authority. By signing this Agreement, you certify and warrant that you are the legal owner (or co-owner) of, and have the legal authority to consent to Data sharing for, all of your dogs.   
    6. Direct Transfer of Embark data to the DDP. By signing this Agreement, you agree to and expressly permit Embark to directly transfer to the DDP, all of your dogs’ Data, without restriction. 
    7. Agreement not to Sue. You agree and promise that you will not institute any action or suit, at law or in equity, against either the DDP or Embark including their employees, volunteers, officers, owners, agents, promoters, operators, representatives, contractors, and/or participants, nor institute, prosecute or in any way aid in the institution or prosecution of any claim, demand, action, or cause of action for damages, costs, loss of services, expenses, or compensation for or on account of any damage, loss or injury either to person or property, or both, whether developed or undeveloped, resulting or to result, known or unknown, past, present or future, arising out of or related to this Agreement, research results, and/or the use, storage, transfer, analysis or security of Data described in Paragraph 3. 
    8. ​Governing Law. This Agreement shall be construed pursuant to the laws of the State of Texas. By signing this Agreement, you consent to the exclusive personal jurisdiction of the courts in and for the State of Texas in the event of litigation pertaining hereto, with venue to lie in Fannin County.
    9. Entire Agreement. This Agreement constitutes the entire Data sharing agreement between you and the DDP, and supersedes all prior agreements and understandings of the parties, oral and written, with respect to the subject matter hereof.
    10. Termination of this agreement. You can terminate this Agreement by email. The DDP agrees to process your termination request within ninety (90) business days. To terminate this Agreement, send your termination request by emailing:
      1. the DDP at Robin.Loreth@DobermanDiversityProject.org, and
      2. Embark at breeders@EmbarkVet.com. 
    11. Sharing Summaries. A "sharing summary" is a record detailing Data sharing by the DDP, and includes the name of the organization with whom Data was shared, date of sharing, a description of the data that was shared, and contact information for the receiving organization. You can, at any time, request (by email) a DDP Sharing Summary. The DDP agrees to provide to you a Sharing Summary within ninety (90) days from the date of your email. One summary per calendar year is provided at no cost. Additional summaries are available at a cost of $20 each, payable to the DDP. To request a Sharing Summary, email Robin.Loreth@DobermanDiversityProject.org and ask for a Sharing Summary. Your email must include your name, your email, a list of all of your dogs’ names and their respective DDPD identification numbers. 

    I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. 

    This Agreement covers ALL of your dogs tested through the either Embark Veterinary and/or the DDP. ​​
    Please provide us with all email addresses that may have been used to communicate with the DDP and/or Embark Veterinary. This will help us to identify each dog you have tested with us.
